HONOLULU, Hawaii, June 23, 2008 — Routh Crabtree Olsen, P.S., a full-service mortgage banking law firm with offices throughout the Western United States, has announced a new change in Hawaii foreclosure law.
The Hawaii Legislature recently enacted Act 138 (08). It mandates that all foreclosures (not just judicial foreclosures) in Hawaii must be handled by an attorney who is licensed to practice law in Hawaii and who is physically located in Hawaii. This effectively eliminates the use of trustee companies in Hawaii, prevents lenders from handling their own foreclosures in that state and is a major change in the Hawaii foreclosure practice.
This change applies to any foreclosure commenced after June 3, 2008.
